I hereby certify that all information in this application, any attachment, and related “new hire’ forms (collectively known as “Application”) is true and complete, and I understand that such information is subject to verification at any time. In the event of employment:
1. I understand that misrepresentation or omission of any fact called for is cause for dismissal regardless of time of discovery.
2. I understand that Epic participates in the E-Verify Program and as such will provide the Social Security Administration, and if necessary, the Department of Homeland Security, with information from my I-9 Form to confirm my work authorization.
3. I understand and agree that my employment is for no definite period and is of an “at will” nature and may, regardless of date of payment of wages, salary, commissions, bonuses, etc., be terminated at any time without previous notice, with or without cause.
4. I also understand and agree that neither this document nor any offer of employment from the employer constitute an employment contract unless a specific written document to that effect is executed by an authorized executive of the employer and the employee.
5. I understand and agree that I am required to abide by all rules, policies, and regulations of the employer.
6. I further understand that only persons who have a legitimate business reason in the course and conduct of the employer’s business will have access to my I-9 information and or Social Security number, including, but not limited to, Epic clients, contractors, subcontractors, vendors, and government agencies. Such access will be granted through the Human Resources Department. Any individual or entity granted such access shall take all necessary precautions at all times to ensure the integrity of records that include such numbers and confidential information.
7. I hereby consent to employer withholding wages or remuneration from my paycheck to (a) obtain repayment of any loan(s) or advance(s), (b) recover any payroll overpayment, and/or (c) recoup costs associated with unpaid merchandise or uniforms purchased by me.
8. I hereby consent to employer withholding wages from my final paycheck to (a) recover property provided to me that I have not returned (including, but not limited to cell phones and equipment), (b) obtain repayments of any loan(s) or advance(s), (c) recover payroll overpayment, and/or (d) recoup the cost or unpaid balance of merchandise, uniforms, or equipment purchased by me. Furthermore upon termination, I agree to return any and all Confidential employer information.

Thank you for your interest in Epic Landscape Productions, L.C. (“EPIC”). We at Epic want to make it very clear, so that there are no surprises and so that everyone is fully informed, that EPIC does not pay overtime to its Landscape Laborers or Foremen and that EPIC does not pay overtime to its Lawn Maintenance Laborers or Foremen. Without going into detail, the reason is straight-forward: EPIC is subject to the U.S. Department of Transportation (“DOT”) Secretary’s regulations since Epic is considered to be a private motor carrier involved in interstate commerce using vehicles that equal or exceed the threshold weight limits (“CMVs”) in the normal course of its landscape and lawn maintenance business. As such, the DOT’s rule making authority extends over Epic’s business operations and supersedes the authority of the Department of Labor (“DOL”) Secretary for those Epic laborers and foremen involved in the safety sensitive functions of Epic’s interstate operations as a private motor carrier operating CMVs as defined under the applicable DOT law and regulations. The DOT rules, rather than DOL rules, govern how Epic pays its landscape and lawn maintenance laborers and foremen involved in these safety sensitive functions and does not require overtime compensation. Much more may be said, but this is a brief summary.
Epic works hard and commits many resources to comply with federal, state, and local laws regarding regulatory compliance, including DOT and DOL, and to operate the business with integrity.
